1. Order Acceptance

A contract for the sale of product(s) you order from us is only created once your order has been dispatched.

Orders are subject to availability.

We will not be legally bound by any factual or typographical errors on this website or other promotional materials.

2. Price

All prices listed on this website are subject to confirmation.

We will notify you by email within hours of making a purchase if the confirmed price of an item you have selected differs from the price listed on the website or on your purchase order.

If you receive such notification, the sale will be automatically terminated unless you reply by email with confirmation or your intention to purchase the item at the confirmed price.

3. Delivery

You shall be given an estimated time for delivery at the time your order is confirmed. If the goods are not available for delivery within 30 days of being ordered, you shall be entitled to cancel your order and receive a full refund of any monies paid.

Where goods become available for delivery at different times, we reserve the right to deliver them in stages.

We will use commercially reasonable efforts to deliver items as quickly as possible and within any time periods indicated; however, we will not be responsible for any delays in delivery which are beyond our control. Where delivery is delayed, we will notify you as soon as possible.

4. Returns

If you decide you do not require the goods, you may return the goods to us within ten days from the date on which you received them, provided they are returned in their original packaging and in perfect condition.

Unless we made an error in order processing or shipping, return shipping fees will apply.

We are not responsible for any damage that may occur during the return shipment of your order.

If any goods are returned damaged, we reserve the right to levy a charge commensurate with our costs of processing the sale.

We will refund the purchase price of the goods within 30 days of the order being cancelled. All charges will be automatically deducted from your refund amount.

5. Fraud Prevention

In order to protect you and Gameplan from fraudulent transactions, we may provide your transaction-related information to a reputable third party organization to perform an address verification. This address verification is intended to ensure that the "bill to" address that you provide matches your credit card address.

We also reserves the right, at our discretion, not to ship items ordered or purchased on this website to certain addresses. In the event that we choose not to ship an item, you will be notified by email and any amount charged to your credit card or PayPal-account will be refunded.

6. Website Update

We may correct errors or inaccuracies and change or update information on this website at any time without notice, including in respect of prices and availability of items.

7. Liability and Disclaimer

To fullest extent permitted at law and except in respect of death and personal injury caused by negligence on our part or on the part of our employees we shall not be liable to you by reason of any representation (unless fraudulent) or any implied warranty condition or other term or any duty at common law or under express terms of the contract for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by negligence on our part or the part of our employees or agents or otherwise) which arise from or in connection with the use of this website, the supply of goods or their use or resale by you. And our entire liability under or in connection with the contract shall not exceed the price of the goods, except expressly provided in these conditions. This does not affect your statutory rights.

These Terms and Conditions cannot be varied except in writing signed by an authorized person at Gameplan.

9. Governing Law and Jurisdiction

This website (excluding linked web sites) is controlled by Gameplan from its office within the Province of British Columbia, Canada. By accessing this website, you agree that the use of this website and any order or purchase made through the facilities of this website shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

You also agree and hereby submit to the exclusive personal jurisdiction and venue of the courts of the Province of British Columbia and acknowledge that you do so voluntarily and are responsible for complying with local laws.
